California’s Courtroom of Attraction has rejected Metallica‘s lawsuit in opposition to their insurance coverage firm over COVID-related losses.

The lawsuit was initially filed in June 2021 in opposition to the band’s insurer Lloyd’s Of London, when Metallica claimed that the corporate refused to cowl losses after their South American tour was cancelled in April 2020.

On the time, Metallica submitted a lack of $3.2 million. Lloyd’s Of London responded to the band, stating that “Sadly we have now to advise that no protection is afforded for this matter below this Coverage,” that means that pandemic-related causes weren’t coated. Lloyd’s Of London particularly cited their coverage’s communicable illness exclusion, which Metallica stated is “an unreasonably restrictive interpretation of the coverage” and was being referred to as a breach of contract.

Metallica‘s case was finally dismissed in December 2022, although the band argued that the lawsuit ought to go to trial as a jury might cause that non-COVID-related points led to the cancellations.

Now Justice Maria Stratton has handed down a choice, dismissing the lawsuit as soon as and for all based on Billboard. Stratton‘s opinion partially learn: “To paraphrase Taylor Swift: ‘We have been there. We bear in mind all of it too effectively.’

“There was no vaccine in opposition to Covid-19 in March 2020 and no medicine to deal with it. Ventilators have been in brief provide. N-95 masks have been all however non-existent. Sufferers have been being handled in tents in hospital parking tons. The mortality price of Covid-19 was unknown, however to offer only one instance of the potential fatality price, by late March, 2020, New York Metropolis was utilizing refrigerated vehicles as non permanent morgues. Folks have been terrified.”

Stratton continued: “Folks have been ready to make a extra correct cost-benefit evaluation of restrictions versus potential sickness. The truth that governments selected to elevate restrictions at that time, two years after COVID-19 was first found, doesn’t in any method name into query their causes for imposing journey restrictions early within the pandemic.”

Metallica‘s authorized staff has not but commented on the lawsuit being dismissed.
